By accessing the Mixedin website, www.mixedin.com.au (the “Site”) and by submitting Postings (defined below) to Mixedin you agree to be bound by the following terms of use. We may modify these terms of use at any time. In addition to these Terms of Use, you must comply with any other rules posted by us anywhere else on this Site.

The Mixedin website is owned and operated by Mixedin Pty Ltd (“Mixedin”, “us”' or “we”) a company incorporated in NSW, Australia.

Intellectual Property

The name Mixedin, the Mixedin domain names and the content on the Site, including any text, images, photos, logos and messages in forums, (the “Content”), is owned by Mixedin. In addition, except with our permission in writing:
•  We do not permit the use of the Mixedin name or logo on any type of promotional materials, flyers or other websites;
•  You may not use or reproduce or allow anyone to use or reproduce the Content without the written consent of Mixedin;
•  The code and software that operates the website is proprietary and you must not copy, reverse engineer or modify it.

Registration

Users agree to provide true, accurate and complete information when registering on the Mixedin website and when submitting Content. If we become aware that a User is not using their true identity, we reserve the right to terminate that User's use of the website and Mixedin's services.

Posting Content

Mixedin is an online site for its members ("Users") to post information about events and activities online ("Postings"). You are solely responsible for all information that you submit to Mixedin and any consequences that may result from your posting of information on Mixedin. We do not edit Postings, we do however, reserve the right to refuse or delete Postings that we believe are inappropriate. Mixedin has no responsibility or liability to store any information posted on the Site.

By posting any Content to the Site, you licence Mixedin to reproduce, modify or distribute that Content in any form and you waive any moral rights that you may have in that Content. You must not do any of the following on the Mixedin Site:
• Post anything that contains copyrighted or proprietary material which you do not own or are licensed to use;
• Post anything that contains advertising or 'spam';
• Post multiple versions of the same event (except where an event repeats);
• Post anything defamatory, indecent, threatening, misleading or otherwise containing illegal Content;
• Post anything which invades personal privacy, is pornographic or obscene or incites violence;
• Post anything containing financial advice or recommendations regarding securities;
• Post anything containing a virus or code designed to interrupt the Site or infect other udders computers.
If you post information of comments to Mixedin that contains false contact details or you impersonate another party we reserve the right to pass your details and IP address on to the aggrieved third party, their agents or any law enforcement agency.

As a User you represent and warrant that:
• You are the sole copyright owner (or have the written consent, release, and/or permission of the Content owner) of Content posted to the site and own and/or controls the rights to the Content;
• You have the right to enter into this agreement;
• Any costs you may incur in connection with the submission of any Content will be borne by you.

Disclaimer of Liability

The information contained on this community website is for information purposes and whilst every care has been taken in its preparation, Mixedin does not make any warranties nor representations as to its accuracy or reliability.

Mixedin does not in any event accept liability of any description:
• for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law in any jurisdiction.

Mixedin provides the Service and the Site 'as is' and without any express or implied warranties. Mixedin excludes all liability to users for loss arising from Content posted on the Site. All warranties of any kind are excluded to the extent permitted by law.

Due to any number of factors outside of our control, Mixedin cannot and does not guarantee uninterrupted, error-free or secure access to the Site.
